BY ENTERING OR OTHERWISE PARTICIPATING, YOU AGREE TO THESE OFFICIAL RULES, WHICH ARE A CONTRACT. WITHOUT LIMITATION, THIS CONTRACT INCLUDES: (A) A LIABILITY RELEASE; (B) AN AGREEMENT TO BINDING ARBITRATION WITH NO CLASS RELIEF; AND (C) LIMITATIONS ON YOUR RIGHTS AND REMEDIES.
ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION WITH NO CLASS RELIEF (SEE §13).
1. Sponsor
Legacy Performance (âSponsorâ), 24485 Belmar Drive, Elkhart, Indiana 46517, United States.
2. Eligibility
Open only to legal residents of the forty-eight (48) contiguous United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees, officers, and representatives of Sponsor and its affiliates, agencies, and their immediate family/household members are not eligible. Business entities are not eligible. Void in Alaska, Hawaii, and where prohibited. All federal, state, and local laws and regulations apply. Participation constitutes entrantâs full and unconditional agreement to these Official Rules and Sponsorâs decisions, which are final and binding.
3. Promotion Period
Begins September 26, 2025 at 12:00:00 a.m. Eastern Time (ET) and ends October 17, 2025 at 11:59:59 p.m. ET (the âPromotion Periodâ). Sponsorâs computer is the official time-keeping device.
4. How to Enter (No Purchase Necessary; Equal Odds)
(a) Purchase Entry (Online): Receive one (1) entry for every $5 (USD) spent on eligible products purchased at www.legacyperformance.com during the Promotion Period. Subscription purchases during the Promotion Period also earn entries on the same basis. Taxes, shipping, discounts, and fees are excluded from entry calculation. Entry will be deemed made by the authorized cardholder or account holder who completes the transaction. By purchasing, you may receive marketing emails from Sponsor; you can opt out at any time without affecting your chances of winning.
(b) Mail-In AMOE (Free): To receive five (5) entries without making any purchase, hand-print on a 3" x 5" card: your full name, street address, city, state, ZIP, date of birth (mm/dd/yyyy), email, and daytime phone. Mail in a hand-addressed #10 envelope with first-class postage to: Legacy Performance Giveaway, 24485 Belmar Drive, Elkhart, Indiana 46517, United States. Limit one (1) entry card per outer envelope. No metered mail, photocopies, or bulk shipments. Outer envelope must include a handwritten return address with first and last name. Mail-ins must be postmarked by October 18, 2025 and received by October 23, 2025 to be eligible. Proof of mailing does not constitute proof of receipt. Sponsor is not responsible for lost, late, damaged, misdirected, or postage-due mail.
(c) General Entry Conditions: There is no maximum number of entries per person; however, automated, programmatic, or fraudulent entries are prohibited and void. Entries must comply with these Rules. All entries become Sponsorâs property and will not be acknowledged or returned.
5. Prize
One (1) prize:
⢠One (1) Ninja Creami (ARV $229.99); and
⢠Two (2) tubs of Legacy Protein Blend (ARV $99.98).
Total ARV: $329.97. No cash alternative or substitution except Sponsor may substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason.
6. Winner Selection & Notification
Random Drawing: On or about October 24, 2025, Sponsor (or its designee) will conduct a random drawing from among all eligible entries received. A reputable third-party randomization tool or application (e.g., ViralSweep or comparable) may be used. Odds of winning depend on the number of eligible entries received via all methods.
Notification: The potential winner will be announced on Legacy Performanceâs Instagram Stories or Reels on or after the drawing date and contacted using the information provided. The potential winner must respond and complete verification (eligibility/identity/residency) and provide a valid shipping address within five (5) days of notification. Failure to timely respond or complete verification may result in disqualification and selection of an alternate winner.
7. Prize Fulfillment
Upon verification, Sponsor will ship the prize at Sponsorâs expense to a street address in the forty-eight (48) contiguous U.S. or D.C. within approximately 2â4 weeks. Sponsor is not responsible for delays or issues caused by carriers, supply constraints, or circumstances beyond Sponsorâs control.
8. Odds
Odds depend on the total number of eligible entries received.
9. Publicity
Except where prohibited, acceptance of the prize constitutes permission for Sponsor to use winnerâs name, city/state, likeness, and statements for advertising and promotional purposes in any media without additional compensation.
10. Release & Limitation of Liability
By participating, entrants agree to release, discharge, and hold harmless Sponsor, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, or damages arising out of participation or the acceptance, possession, or use/misuse of the prize. Sponsor is not responsible for: (i) incorrect or inaccurate information; (ii) technical failures; (iii) unauthorized human intervention; or (iv) any injury or damage to persons or property related to participation.
11. Compliance & Instagram Disclosure
This Giveaway is intended to comply with applicable U.S. federal and Indiana state law, including providing a free alternate method of entry to avoid constituting an illegal lottery. This promotion is in no way sponsored, endorsed, administered by, or associated with Instagram. You understand you are providing your information to Sponsor and not to Instagram.
12. Taxes
Winner is solely responsible for all federal, state, and local taxes and any other costs not expressly stated as provided herein. Sponsor will issue an IRS Form 1099 if required by law.
13. Dispute Resolution; Governing Law; No Class Relief
Governing Law: Indiana law governs, without regard to conflict-of-law principles.
Binding Arbitration: Any dispute or claim arising out of or relating to this Giveaway or these Rules shall be resolved by binding arbitration administered by the American Arbitration Association (âAAAâ) under its Consumer Arbitration Rules. Arbitration seat and hearings: Elkhart County, Indiana (or via video/teleconference by mutual consent). The arbitrator shall apply Indiana law. No Class Actions: Proceedings are on an individual basis only; class, collective, or representative actions are not permitted.
Small-Claims Carve-Out / Court Entry of Judgment: Either party may bring an individual claim in small-claims court with jurisdiction, and any court of competent jurisdiction may enter judgment on the arbitration award or address applications for injunctive relief as permitted by law.
14. Privacy
Personal information collected in connection with this Giveaway will be used in accordance with Sponsorâs Privacy Policy.
15. Winner List
